END USER LICENSE AGREEMENT

Please read this EULA carefully before completing the installation process of the Font Software and
be respectful of my work by purchasing the correct license.

INTRODUCTION

This End-User License Agreement (“EULA“) is a legal agreement between Nora Kaszanyi and you or the User or the Licensee, and establishes the terms and conditions by which you are permitted to install and use the licensed Font Software (Gaia Display).

Please read this EULA carefully before completing the installation process of the Font Software. It provides a license to use the Font Software and contains warranty information and liability disclaimers.

By downloading, installing and/or using the Licensed Font Software, you confirm that you have read, understand and agree to be bound by the terms of this agreement. This agreement does not create third party beneficiary rights for any parties. If you do not agree to the terms of this agreement, do not install the Licensed Font Software.

OWNERSHIP

What you are purchasing is a license to use digital typeface software - hereafter “font” - for a certain number of authorized users within your organization; you are not purchasing the copyright to the design of the fonts, but the rights to use the fonts. Purchase of Font is for the number of user licensed for. Please make sure the number desktop users, correlates to the number of users. These users should work for the same organization within the same location. You would need a specific license to use Gaia Display as/in a brand logo.

Please contact Nora Kaszanyi if you require an extension to your license.

A license holder is the purchaser whose coordinates are provided at the moment purchase. The license holder is the person/business who will install the files obtained for use in design work. Please make sure all license restrictions and extents are communicated internally. E.g. If you are limited to three licenses, make sure that the license is extended if more users are required.

The installation of the Typeface without a license is formally prohibited.

NATURE OF RIGHTS

The purchase of Font makes the buyer a licensed user of the Font, not an owner. The license holder can in no way modify the files acquired through the use of any software, in any way, shape or form and for any reason whatever.

This license does not allow the Font to be loaded onto a server which provides for multiple users. Please contact Nora Kaszanyi directly for a quotation on this.The use of the Font for the creation of logotype / brand mark / corporate / merchandise / app / e-pub / politics / broadcasting / etc, constitutes a particular case. This is why, if this corresponds to your situation, please contact Nora Kaszanyi immediately in regard to better understand the specific conditions of use, the extent of the project so to study a specific and appropriate license.

The font are provided in OTF (OpenType) and WOFF/WOFF2 (Web Open Font) format. The .OTF (or .TTF/.EOT - if requested) file should not be converted to any other file formats.

THIRD PARTIES

You may not provide the Font or make it accessible to any other third parties. Businesses and/or physical persons subcontracted or in connection with the owner of a typeface license (designers, developers, printers, publishers, etc.) who, for the implementation of a project, are required to install said typeface are not covered by the license of the business that they are working with and must purchase their own license. The installation of a typeface without a license is formally prohibited. Independent workers working together (in the same place or on a network) can not be considered as a single legal entity. Each worker who is likely to use Gaia Display must acquire their own license.

LIMITATIONS AND PERMISSIONS

You are not permitted to:

• Edit, alter, modify, adapt or otherwise change the whole or any part of the Font to be combined with or become
incorporated in any other typeface, nor decompile, disassemble or reverse engineer the Font or attempt to do any
such things

• Reproduce, share, copy, distribute, resell or otherwise use the Font
• Allow any third party to use the Font on behalf of or for the benefit of any third party
• Use the Font in any way which breaches any applicable local, national or international law
• Use the Font for any purpose that Nora Kaszanyi considers is a breach of this EULA agreement

LINCENSE

Desktop License
Desktop license are based on the number of users that are using the typefaces and comes as
OpenType format.

Web License
The web license is based on the estimated number of page views on the website that are using the files. There are no repeated costs, but you are required to upgrade your license to a bigger version if the monthly number of page views exceeds your previous license.

Logo License
If the Font are used in the logo or word mark of the company, an additional fee applies. It depends on the yearly gross revenue of the company.

Other License
Other licensing constructions are available upon request, these include the use of the Font in EPUBs, Applications or in Broadcasting/Streaming.

LINCENSING OPTIONS

5 levels of licensing I Desktop and Web all together
Please be respectful of our work by purchasing the correct license.

Mini – 1 computer only
This license is made for independent workers only. With this license, you can install the font on
1 computer only. The web font files may be used for 1 domain and maximum 5.000 page views
per month.

Small – 2-5 computers
Allows the installation of the font file on up to 5 computers in the same workplace. The web font files may be used for 1 domain and maximum 20.000 page views per month.

Medium – 6-20 computers
Allows the installation of the font file on up to 20 computers in the same workplace. The web font files may be used for 1 domain and maximum 200.000 page views per month.

Large – 21–50
Allows the installation of the font file on up to 50 computers in the same workplace. The web font files may be used for 1 domain and maximum 2.000.000 page views per month.

Mega - 50 <
Allows the installation of the font file on over 50 computers in the same workplace. There’s no page view limit.

The Font and the accompanying materials are copyrighted and contain proprietary information and trade secrets belonging to Nora Kaszanyi. Unauthorized copying of the Font even if modified, merged, or included with other software, or of the written materials, is expressly forbidden. You may be held legally responsible for any infringement of Nora Kaszanyi’s intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement.

The holder of a license is committed to protecting transmitted files against copying. He will have advised those who have access to the files that they are prohibited from copying, transmitting or using them for themselves or others, whether it is for fee based work or not.

In the case of web uses, the licensee is committed to protecting against the identification and copying of the files installed on the website.

TERRITORIALITY

The holder of the license expressly agrees that this contract shall be drawn up, submitted and interpreted in accordance with Hungarian law as it applies to contracts drawn up on its soil. Any dispute concerning this contract will be brought before the court, the sole court competent to judge such matters. The licensee acknowledges that he has read and understood the terms of this agreement and that by using Nora Kaszanyi’s font he agrees to be bound by these terms and conditions. No variation in the terms of this contract shall apply in the absence of an endorsement or written authorization signed by Nora Kaszanyi.

If you do experience any difficulties with the font, Nora Kaszanyi will look into the problem and hopefully send you a fixed version immediately. Unfortunately Nora Kaszanyi can’t give you a refund. Any usage of the fonts are on your own risk. Nora Kaszanyi does not guarantee that the font files work perfectly on every platform, operating system etc.

All purchases are final. Nora Kaszanyi does not offer any refunds or exchanges for other font files.
Please place your order carefully.

Any breach of the terms and conditions of this agreement terminates your license to use the font.
After any termination of the agreement you must destroy any copies of the font, including your archival copies.

GOVERNING LAW

This EULA agreement and any dispute arising out of or in connection with this EULA agreement shall be governed by and construed in accordance with the laws of Hungary.
